ButSam Zell, chairman ofEquity Group Investmentsand renowned real estate investor based in Chicago, recently joined the list of folks taking activist Ackman to task on his Herbalife pronouncements.

Obviously when looking at things like real estate you don go by what it says on the balance sheet. You try to find a note on depreciation that breaks out land, buildings, etc. And gives information about how the company depreciates its property.

And of course you look at the ropertiesitem in the 10-K. In the U.S., you then use the information youe gathered to check county land records and things like that for more information about the property.

Advisors' Opinion:

Rich Duprey's article "Will Obamacare Carve up the Restaurant Industry?" builds on these concerns. Rich cites statements from CEOs of multiple restaurant chains about the possibility that worker hours will be cut to avoid the added premiums. The head of Papa John's (NASDAQ: PZZA  ) said that it's "common sense" to do so, and Darden Restaurants (NYSE: DRI  ) , the parent company of Olive Garden and Red Lobster, experimented with a plan to hire more part-time workers last year before abandoning it in the face of a customer backlash.

Last month, Oaktree Capital (OAK), managed by another distressed investing icon, Howard Marks, disclosed a huge 21.9% stake in Star Bulk Carriers (SBLK).

  • [By James E. Brumley]

It's certainly no Safe Bulkers, Inc. (NYSE:SB) or Star Bulk Carriers Corp. (NASDAQ:SBLK), in terms or market cap or revenue. In fact, even with the drybulk shipping industry it's a somewhat obscure name. Yet, FreeSeas Inc. (NASDAQ:FREE) may well be the stock with the most near-term potential upside, now that it's gotten over a key technical hump.

  • [By James E. Brumley]

I'll warn you now that if you're a fan or shareholder of Star Bulk Carriers Corp. (NASDAQ:SBLK), then you're not going to like what you're about to read. Before you fly off into a tirade of "colorful" descriptions of me, however, know that this is neither a judgment call on the company itself, nor a long-term outlook. It's simply a trading-based observation of hints that SBLK has dropped today. Fair enough? OK, let's dig in.

Advisors' Opinion:
  • [By Rich Duprey]

Yet, Europe's leading potash player K+S (NASDAQOTH: KPLUY  ) just said that, because of the upheaval that's occurred in the market, it was slashing its dividend by 82% for 2013,reducing the payout ratio to just 11% of adjusted after taxearnings, a far cry from the miner's usualratio of between 40% and 50%. Could this signal a new era of austerity that will ultimately see Potash,Agrium (NYSE: AGU  ) , and Mosaic (NYSE: MOS  ) end up whacking their payouts, as well?
